Product Review Policy

This Policy explains how Bing Lee collects, moderates and displays customer reviews for the products we sell ("Review"). It applies to voluntary Reviews as well as Reviews submitted under a promotion or other incentive offered by Bing Lee, affiliates, agents and suppliers.

Bing Lee handles Reviews consistent with its obligations under the Australian Consumer Law and the ACCC guidance on online reviews.

A voluntary review is a Review submitted without any incentive from Bing Lee. Any customer who has purchased and used a Product from us may submit a voluntary Review through our website "binglee.com.au". No payment, discount or reward is offered in exchange for a voluntary Review.

From time to time Bing Lee or its affiliates, suppliers or agents may encourage customers to submit a Review, including by running a promotion under which customers who submit a Review are entered into a competition or receive another benefit ("Incentivised Review"). For each Incentivised Review:

• the incentive will be clearly disclosed to the reviewer at the time of entry;

• entry into the relevant promotion or receipt of the benefit is not conditional on a positive Review or a particular rating;

• the Review will be published with a visible label or identifier such as "Incentivised Review" so the reader knows an incentive was offered for the Review;

• the reviewer must give an honest opinion based on actual use of the relevant Product;

• Bing Lee may publish disclosure language such as "This review was incentivised by Bing Lee or its affiliate, supplier or agent"; and

• all other terms of this Policy will apply to the Review.

A Review must:

• reflect the reviewer's genuine experience;

• be accurate, relevant and not misleading;

• be only in respect of a Product and based on actual use of that Product; and

• not include false claims about performance, origin or safety.

Bing Lee reserves the right to not publish and may edit or remove a Review that:

• is false (fake), fabricated or written on behalf of another person;

• is given under an incentive that is not disclosed;

• contains defamatory, abusive, discriminatory or unlawful material or otherwise could potentially incite civil unrest;

• includes personal data (other than the Participant's name), confidential information or unauthorised third-party intellectual property;

• promotes unrelated products or services, Bing Lee competitors or includes spam or other links; or

• is produced by bots, automated tools or generative AI or forms part of a bulk or co-ordinated submission.

Bing Lee reserves the right in respect of a Review, in its absolute discretion, to:

• verify Product or purchase information or usage;

• edit for minor formatting without altering meaning; and

• reject, edit or remove a Review or content that does not conform with this Policy.

A reviewer who uploads any photograph, video, image, audio or other content with a Review ("Content") warrants that:

• the Content is the reviewer's own original content or the reviewer holds a valid licence and all permissions necessary to upload it and to grant the rights set out in this Policy;

• the Content does not infringe the copyright, moral rights, trade marks or other intellectual property right of any third party;

• the Content does not contain identifiable images of any person without that person's consent; and

• the reviewer indemnifies Bing Lee against any claim by a third party arising from Content that infringes this policy.

Bing Lee may remove Content if it has reasonable grounds to believe any of these warranties has been breached.

To meet best practice in respect of online reviews, Bing Lee will:

• display all qualifying Reviews, both positive and negative, without selective filtering;

• not edit a Review in a way that changes its meaning or rating;

• indicate the age of the Review and the overall rating for the relevant product;

• label Reviews as "Incentivised" where an incentive was provided for the Review; and

• only remove or edit a Review where it breaches this Policy.

Bing Lee may use published Reviews on the Website, in marketing material and on third-party platforms in respect of the relevant Product. By submitting a Review the reviewer grants Bing Lee a non-exclusive royalty-free licence to do so and waives any moral rights to the extent permitted by law.

Reviews will be managed and/or vetted by Bing Lee or its nominated third party agent for compliance with this Policy.

A customer who believes a published Review is false, misleading or in breach of this Policy may report it to Bing Lee at [email protected]. Bing Lee will assess the report and remove the Review in its discretion and where it does not comply with this Policy.

Bing Lee reserves the right to make changes to this Policy from time to time.  Any changes to the Policy will be published on Bing Lee's website. Bing Lee encourages You to periodically review this Policy for the latest information on Bing Lee's Product Review requirements.
